Please read this End User License Agreement (the "Agreement") carefully before downloading, installing, accessing, or using Pocket Rogues. By downloading, installing, accessing, using, or continuing to use the Game, you agree to this Agreement.

If you do not agree to this Agreement, do not download, install, access, or use the Game.

This Agreement is a license agreement, not a sale agreement. Pocket Rogues is licensed to you, not sold.

Unless the context clearly indicates otherwise, references to "Pocket Rogues" in this Agreement also include Pocket Rogues: Ultimate.

The Game is distributed through official platforms: Google Play, the Apple App Store, and Steam. You must install and use the Game only from these official sources or other Authorized Platforms approved by EtherGaming. Installing or using the Game from unofficial sources is not permitted and is not supported.

EtherGaming is not responsible for modified, pirated, tampered, or malicious copies of the Game obtained outside official sources.

1. Definitions

In this Agreement:

• "Game" means Pocket Rogues, Pocket Rogues: Ultimate, and any related software, updates, patches, downloadable content, online features, websites, services, and documentation provided by EtherGaming.
• "EtherGaming", "we", "us", or "our" means the developer and publisher of the Game.
• "User", "you", or "your" means any person who downloads, installs, accesses, or uses the Game.
• "Authorized Platform" means Steam, Google Play, the Apple App Store, or any other storefront, launcher, website, or distribution channel officially approved by EtherGaming.

2. Eligibility and acceptance

You may use the Game only if you are legally allowed to enter into this Agreement and meet the minimum age and content rating requirements that apply in your country or on the Authorized Platform you use.

If you are under the age of legal majority in your country, your parent or legal guardian must review and accept this Agreement on your behalf.

By using the Game, you confirm that you have the legal right to use the device, account, storefront, and payment method involved in your use of the Game.

3. License grant

Subject to your compliance with this Agreement, EtherGaming grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game for personal, non-commercial entertainment purposes on devices and accounts that you own or control, as permitted by the rules of the Authorized Platform from which you obtained the Game.

This license does not give you ownership of the Game or any part of it. All rights not expressly granted to you in this Agreement are reserved by EtherGaming and its licensors.

4. Authorized copies and unofficial versions

You may obtain and use the Game only through Google Play, the Apple App Store, Steam, or other Authorized Platforms expressly approved by EtherGaming.

Installing the Game from unofficial websites, repacks, third-party stores, or other unapproved sources is not permitted and is not supported under this Agreement.

Unofficial, modified, pirated, tampered, or repackaged copies of the Game are not licensed under this Agreement. EtherGaming is not responsible for any loss, damage, malware, data corruption, privacy risk, account issue, or device issue caused by unofficial copies or third-party modifications.

EtherGaming may restrict access to online features, cloud saves, leaderboards, achievements, or support services for unofficial, modified, or suspicious versions of the Game.

5. Ownership and intellectual property

The Game, including its code, gameplay systems, characters, names, artwork, animations, audio, music, text, lore, interface, design, visual style, items, locations, monsters, bosses, logos, trademarks, and all other game content, is owned by EtherGaming or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not use the Game's content, trademarks, logos, or branding in a way that suggests endorsement, sponsorship, partnership, or official status unless EtherGaming gives you written permission.

6. Restrictions and rules of conduct

You must install the Game only from official app stores (Google Play, the Apple App Store, or Steam) or other Authorized Platforms approved by EtherGaming.

You agree that you will not, and will not help others to:

1. copy, sell, rent, lease, sublicense, distribute, publish, or make the Game available except as expressly permitted by this Agreement or the rules of an Authorized Platform;
2. modify the Game application, reverse engineer, decompile, disassemble, derive source code from, or interfere with the Game code or protection systems, except where such restriction is prohibited by applicable law;
3. bypass, disable, or interfere with any technical protection, account system, payment system, anti-cheat system, platform restriction, or security feature;
4. use cheats, bots, automation, memory editors, trainers, unauthorized scripts, exploits, save abuse, cloud save abuse, glitch abuse, or other tools that alter intended gameplay, progression, economy, online services, or competitive results;
5. exploit bugs, vulnerabilities, cloud save behavior, platform APIs, or account systems to obtain unfair progress, currency, items, achievements, leaderboard results, or other benefits;
6. take actions that clearly and intentionally affect another player's progress, account, data, or experience outside intended gameplay;
7. sell, resell, trade, transfer, or commercially exploit accounts, save files, in-game currency, Crystals, items, achievements, services, or access to the Game for real money outside systems expressly approved by EtherGaming;
8. use the Game or related services to harass, threaten, defame, abuse, impersonate, deceive, spam, or otherwise harm other users or third parties;
9. in optional online multiplayer, use insults, harassment, abusive language, or other disruptive conduct toward other players;
10. introduce, transmit, or attempt to distribute malware, harmful code, illegal content, or other material that violates this Agreement, applicable law, or the rules of an Authorized Platform through the Game or related services;
11. use the Game for any illegal, harmful, or commercial purpose not expressly authorized by EtherGaming.

Security vulnerabilities, serious exploits, and account issues should be reported directly to EtherGaming at ethergaminginc@gmail.com. Do not publicly share instructions for abusing an exploit. Public disclosure may result in restrictions on your access to online features.

7. Online features, accounts, cloud saves, and multiplayer

The Game can be played offline without creating an account. Registration is not required to access the core single-player content of the Game.

Some optional online features may require an in-game account, an internet connection, a platform account, or third-party services. These features may include cloud saves, optional online multiplayer, leaderboards, achievements, and account-related support services.

Cloud saves are intended to back up your progress and, where supported, to help transfer progress between devices or platforms. Cloud saves and local saves may be affected by device changes, platform limits, connectivity issues, version differences, user error, file corruption, or service interruptions. You are responsible for keeping appropriate backups where possible.

The Game includes optional online multiplayer functionality. Multiplayer is not required to play the Game or access its main content. Access to multiplayer may require an in-game account and compliance with the conduct rules in this Agreement. EtherGaming does not guarantee that multiplayer servers, matchmaking, or related online services will always be available or free from limits, interruptions, or changes.

EtherGaming may suspend, limit, modify, reset, or discontinue online features when reasonably necessary for security, maintenance, legal compliance, abuse prevention, technical limits, or continued operation of the Game.

8. Enforcement and account measures

If EtherGaming reasonably believes that you violated this Agreement, abused online features, used unauthorized modifications, manipulated saves or progression, harmed other users, misused multiplayer or other online features, or otherwise acted outside the intended use of the Game, EtherGaming may take appropriate action.

Such action may include restricting access to online features; removing or adjusting unfairly obtained items, currency, Crystals, progress, leaderboard entries, achievements, or other data; suspending, blocking, or freezing an account; or refusing support for affected data.

Where the Game technically allows it, restrictions on online features do not necessarily prevent you from continuing offline play. EtherGaming does not guarantee continued access to any particular online feature, save file, account, or service after a violation.

9. Purchases, Crystals, and virtual items

The Game may offer paid versions, downloadable content, and other digital content. On mobile platforms, the Game may also offer in-app purchases.

Crystals are virtual currency or consumable digital items in the Game. Crystals can speed up progress, but the main game content does not require mandatory purchase of Crystals to be accessed.

Purchases are handled by the Authorized Platform through which the purchase is made, and that platform's payment, refund, tax, and billing rules may apply.

Virtual currency and virtual items are licensed digital content. They have no cash value, are not money or property, and cannot be sold, transferred, exchanged, or redeemed for real money except where expressly required by applicable law or expressly allowed by the Authorized Platform.

Consumable digital content may be depleted when used. Used consumables may not be restorable after use, even if a purchase record can be verified, unless required by applicable law or platform rules.

EtherGaming may modify, rebalance, rename, replace, limit, or discontinue virtual items, virtual currency, prices, rewards, progression systems, and in-game economies as part of updates, balancing, maintenance, or service changes, subject to applicable law and platform rules.

Refund requests should generally be made through the platform where the purchase was made. You may also contact EtherGaming at ethergaminginc@gmail.com for support, but the final processing of platform purchases is often controlled by the relevant Authorized Platform.

10. Community content, videos, and streaming

You may create and share screenshots, gameplay videos, livestreams, reviews, guides, fan art, and other community content based on the Game for non-commercial or platform-monetized community purposes, provided that you do not misrepresent your content as official, do not use EtherGaming branding in a misleading way, and do not violate this Agreement or applicable law.

This permission does not allow you to redistribute the Game, extract and sell Game assets, create a competing product using Game content, or use the Game's intellectual property in merchandise, advertising, paid products, or commercial services without written permission from EtherGaming.

11. Third-party services and external links

The Game, website, or related services may include links to third-party websites, storefronts, communities, SDKs, APIs, or services. EtherGaming does not control third-party services and is not responsible for their content, availability, security, data practices, policies, or actions.

Your use of third-party services is at your own risk and may be subject to separate terms. See the Privacy Policy for how related data is handled.

12. Updates and changes to the Game

EtherGaming may provide updates, patches, fixes, balance changes, content changes, technical changes, compatibility changes, or feature changes. Some updates may be required to continue using online features.

EtherGaming may add, modify, suspend, or remove content, mechanics, features, services, platform integrations, or support for older versions where reasonably necessary for development, security, legal compliance, platform compliance, or technical reasons.

13. Privacy

Your use of the Game may involve processing of account, save, purchase, and related data as described in the Privacy Policy. The Privacy Policy is separate from this Agreement.

14. No warranty

To the maximum extent permitted by applicable law, the Game and related services are provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied, or statutory.

EtherGaming does not warrant that the Game or related services will be uninterrupted, error-free, secure, compatible with every device, compatible with every save file, free from data loss, or available at all times.

Nothing in this Agreement limits any mandatory consumer rights that cannot be waived under applicable law.

15. Limitation of liability

To the maximum extent permitted by applicable law, EtherGaming will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of progress, business interruption, device issues, or inability to use the Game or related services.

To the maximum extent permitted by applicable law, EtherGaming's total liability arising out of or related to the Game or this Agreement will not exceed the amount you paid directly for the Game or relevant digital content during the twelve months before the claim arose.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, the exclusions and limitations apply only to the maximum extent permitted by law.

16. Indemnity

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold EtherGaming harmless from claims, damages, losses, liabilities, costs, and expenses arising from your violation of this Agreement, your misuse of the Game or related services, or your infringement of third-party rights.

This section does not apply where prohibited by applicable consumer protection law.

17. Termination

This Agreement remains in effect until terminated.

You may terminate this Agreement by uninstalling the Game and ceasing all use of the Game and related services.

EtherGaming may terminate or suspend this Agreement, your license, or your access to online features if you violate this Agreement or if termination is reasonably necessary for legal, security, platform, or operational reasons.

After termination, you must stop using the Game and delete any unauthorized copies. Sections that by their nature should survive termination will continue to apply, including ownership, restrictions, warranty disclaimers, limitation of liability, indemnity, governing law, and platform-specific terms.

18. Changes to this Agreement

EtherGaming may update this Agreement from time to time. The updated version will be posted on the Pocket Rogues website or made available through the Game or an Authorized Platform.

If a change is material, EtherGaming may provide additional notice where reasonably possible. Your continued use of the Game after the updated Agreement becomes effective means that you accept the updated Agreement.

19. Governing law

Unless mandatory law in your country provides otherwise, this Agreement is governed by the laws of Ukraine, without regard to conflict of law rules.

Nothing in this Agreement limits any mandatory rights or remedies that you may have under the consumer protection laws of your country of residence.

20. Platform-specific terms

Apple App Store

If you obtained the Game through the Apple App Store, the following additional terms apply:

1. The license granted to you is limited to use of the Game on Apple-branded products that you own or control, as permitted by Apple Media Services Terms and Apple's Usage Rules.
2. Apple is not responsible for providing maintenance or support services for the Game.
3. To the extent any warranty applies and is not effectively disclaimed, Apple's responsibility is limited to any refund obligations required by applicable App Store rules.
4. Apple is not responsible for claims relating to the Game, including product liability claims, legal compliance claims, consumer protection claims, or intellectual property infringement claims.
5. Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement for the Apple App Store version of the Game and may enforce this Agreement against you.
6. You must comply with applicable third-party terms when using the Game.

Google Play

If you obtained the Game through Google Play, your use of Google Play, Google Play billing, Google Play Games services, refunds, and related platform features may be governed by Google Play's terms and policies in addition to this Agreement.

Steam

If you obtained the Game through Steam, your access to and use of the Game through Steam may also be governed by the Steam Subscriber Agreement, Steam Rules of Use, Steam Refund Policy, and other Steam terms applicable to your account, purchases, community features, or platform services.

If platform terms conflict with this Agreement on matters controlled by that platform, the platform terms may control to the extent required by the platform or applicable law.
